International Court of Justice has rejected South Africa’s plea for immediate measures to protect Rafah, Southern Gaza, after Israel’s aggressive decision to target the region. Court refused to agree with the imposing of urgent measure, when it directed measure earlier, during the hearing in last month. According to the news reports, ICJ in a statement states, ‘the perilous situations in Rafah demanded immediate and effective implementation of the provisional measures that it ordered on 26 January.’ It also added, ‘No new order was necessary because the existing measures are applicable throughout the Gaza strip, including in Rafah’, quoted India Today.
Israel recently announced to Palestinians to evacuate Rafah, as it is next targeted Hamas’s location. But, according to critics, displacing 1.4 million people from a small region to unknown and secluded place, will make conditions worse. In an interview given to US TV Channel, ABC, Israel’s Prime Minister Benjamin Netanyahu said, ‘We are going to do it while providing safe passage for the civilian population so they can leave.’ He also responded to the question, where big number of population is supposed to go, saying, ‘Areas that we have cleared north of Rafah, there are plenty of areas there, but we are working out a detailed plan to do so’, quoted Al Jazeera.
Political Expert Mukesh Chaturvedi, commented over the situation and said, ‘Israel on the name of fighting against Hamas has killed more than thousands of Palestinians. They are constantly with their aggressive approach, has convinced states to not consider it as a defensive action. Because, states who were supporting them at the beginning, also condemned Israel’s act. Either leaders are keeping quiet or criticizing the whole war. No country is openly supporting Israel after months of war.’ In addition, ‘Death and injured numbers coming from UN agencies is not only disheartening but questions higher authorities and accountability of states and actors’, he said.
Meanwhile ICJ considered the measures in the plea presented by South Africa earlier, but refrained to do so, this time, why? According to Mr. Chaturvedi, ‘South Africa became the first country that presented the Gaza genocide case before International Court. And it handed over all the visuals came from Gaza as evidence. Court acknowledged the suffering based on what all presented, but now it cannot solely decide on the basis of information backed by single party. It requires other states to support the argument.’ However, it is likely witnessed that states do not comply to all the instructions given by Court. UN’s ineffective role in this war appears to be as a failure of international structure. The organization was expected to come up with preventable measures, however, it disappointed by not taking the responsibility. Mr. Chaturvedi told EAT news, even though the entire international community is responsible for this crisis, hoping UN to act is the least, activism can expect. ‘As everybody know, this war has not started suddenly but was an existing dispute in the area. The Israeli occupation became aggressive in last few years and the act of resistance, too. Now, critics are blaming UN for not taking any firm decision earlier, that led Israel to become oppressor without fear of any severe consequences’, he said.
International community did not take this conflict in account earlier, which resulted to this mass destruction, today, according to political expert Mr. Chaturvedi. Director of the International Human Rights Clinic at Boston University, Susan M. Akram in an article published on Open Global Rights, said, ‘The current war and its history reflect a failure of the UN system to prevent and punish war crimes, crimes against humanity, and genocide. However, the responsibility for preventing the gravest of crimes falls not only on the UN but the entire international community, from individual states to civil society- and it is the latter that must prosecute and punish such crimes when the UN fails to do so’. In her article, she mentioned structural imbalance as one of the main reasons behind UN unable to halt this war. According to the information, US has used its veto power around 30 times to stop UN in taking any action against Israel to pause this aggression. While West is supporting Israel, it is also avoiding to speak publicly.
In a recent conversation with reporter, US President Joe Biden called Israel’s’ military operation ‘over the top’ and that suffering of people ‘got to stop’. Simultaneously, Biden is standing with Israel in international community. This is ironical to what he wants to portray publicly. Mr. Chaturvedi called it ‘West diplomacy’ and that it has never benefitted anybody except West countries. The country is monitoring the situation and constantly releasing official statements. On the other side, Hamas is demanding release of hundreds of Palestinians in Israel’s jail, in return of releasing hostages, and end the war.
